QUESTION:

What do the scholars and muftis of the mighty Shari’ah say regarding the following matter, who is qurbāni (sacrifice) wājib upon? Also, is the qurbāni of ‘eid wājib upon those who travel for Hajj?

الجواب بعون الملک الوھاب اللھم ھدایۃ الحق والصواب

Qurbāni is wājib upon the person who is ‘mālik-e-nisāb’ i.e. he possesses 612.35 grams of silver, it’s value in money (according to today’s rate the value of 612.35 grams of silver in England is approximately £257, and according to Pakistani rupees it amounts to approximately 31820 rupees) – or asides basic needs (hājat-e-asliyah) he owns an asset which is worth the same e.g. a shop etc.; if an individual possess one of these three types of wealth (612.35 grams of silver, it’s value in money or an asset of the same value) during the days of sacrifice, qurbāni will be wājib upon him. It is mentioned in Bahār-e-Sharī’at,

“The person who owns 612.35 grams of silver, 20 dīnārs or asides hājat-e-aslī, he is in possession of such a thing which is worth 612.35 grams of silver, such a person is rich (ghanī) and qurbāni is wājib upon him. What is meant by hājat is a place of residence, household items which are required, a riding animal, a servant and clothes to wear, anything which exceeds this is not hājat”.

The qurbāni of ‘eid is not wājib upon a traveller, regardless of whether the journey be for hajj or any other purpose, however, if a hājī is a resident there then it is wājib. For example, if the residents of Makkah were to perform hajj, the qurbāni of ‘eid would be wājib upon them as they are not travellers. Just as it is stated in Bahār-e-Sharī’at,

“Qurbāni is not wājib upon those travellers who perform hajj, but if they are residents then it will be wājib, as is the case for those who reside in Makkah, if they were to perform hajj it would be wājib upon them as they are not travellers”.
